A thorough search of the Stanford Copyright Renewal Database and the Library of Congress Catalog of Copyright Entries (CCE) reveals no renewal registration for this film. To remain protected, Paramount or a successor would have needed to file a renewal in 1962 or 1963. While the 1934 stage play by Samson Raphaelson (on which the film is based) was renewed and remains protected, the 1935 motion picture itself entered the public domain in 1963 due to non-renewal. This film is frequently cited in public domain industry lists, such as the Film Superlist (Hurst/Baer).
