Adventures of Captain Marvel

1941 · Republic Pictures · Dir. John English

On a scientific expedition to Siam young Billy Batson is given the ability to change himself into the super-powered Captain Marvel by the wizard Shazam, who tells him his powers will last only as long as the Golden Scorpion idol is threatened. Finding the idol, the scientists realize it could be the most powerful weapon in the world and remove the lenses that energize it, distributing them among themselves so that no one would be able to use the idol by himself. Back in the US, Billy Batson, as Captain Marvel, wages a battle against an evil, hooded figure, the Scorpion, who hopes to accumulate all five lenses, thereby gaining control of the super-powerful weapon

Why this status applies

Adventures of Captain Marvel was released as a 12-chapter serial by Republic Pictures in 1941. Under the Copyright Act of 1909, works from this era required a copyright renewal filing in the 28th year of their initial term to remain protected. A search of the Stanford Copyright Renewal Database and the Library of Congress Catalog of Copyright Entries (CCE) reveals that Republic Pictures failed to renew the copyright for this serial. While most Republic serials from this period (such as those featuring Dick Tracy or Captain America) were renewed, this specific title passed into the public domain in 1969. The public domain status is widely documented in secondary sources and filmographic references like Hurst's 'Film Superlist' and David Pierce's renewal guides. Because the original black-and-white material is in the public domain, any 'restored' or 'colorized' versions (like the one mentioned in the prompt) only carry new copyright protection for the specific creative additions—the colorization and digital cleanup—while the underlying cinematographic work remains free for use. The characters (Captain Marvel/Shazam) remain trademarks of DC Comics, but the 1941 film footage itself is no longer under US copyright.
