Attack of the Eye Creatures

This film was produced by Larry Buchanan for American International Pictures TV and originally titled 'The Eye Creatures'. It is a remake of the 1957 film 'Invasion of the Saucer Men'. The film was released in 1965, placing it in the 1964–1977 notification era, where US copyright protection was dependent on the inclusion of a valid copyright notice on the release prints. The film is famously known for a typographical error in its title card which reads 'Attack of the THE Eye Creatures', but more importantly, the film was released without a valid US copyright notice. Under the law at the time (17 USC §405), failure to include notice upon publication without a timely registration to cure the omission resulted in the work entering the public domain. Research into the Library of Congress and Stanford renewal records shows no original registration for this title in 1965. Furthermore, the film has been widely recognized as public domain by film historians and legal experts for decades, leading to its frequent appearance in PD collections (such as Alpha Video) and its inclusion in Mystery Science Theater 3000 (Season 4, Episode 18) without the standard licensing restrictions that apply to active AIP titles.
