Death Rage

Originally titled 'Con la rabbia agli occhi', this Italian production was released in the United States in 1976. Under the 1909 Copyright Act (which governed works released prior to 1978), foreign films distributed in the US required a valid US copyright notice to secure protection. There is no record of a US copyright registration for 'Death Rage' or any alternative title for this film in the Catalog of Copyright Entries (CCE) or the US Copyright Office online database. Furthermore, the film was widely distributed in the US by budget labels (such as Alpha Video, Mill Creek, and Brentwood) and appears on numerous public domain film lists. For foreign works whose US copyright may have been restored under the URAA in 1996, restoration only applies if the work was protected in its source country on January 1, 1996. The widespread, unchallenged commercial use of 'Death Rage' by PD-specialist distributors for decades suggests that no US copyright exists. In the absence of a US registration or evidence of valid notice during its 1976 theatrical run, the film is considered to be in the public domain in the United States.
