Lemonade Joe

Lemonade Joe (Limonádový Joe aneb Konská opera) is a 1964 Czechoslovakian musical parody. Because it is a foreign production published in 1964, its US copyright status depends on two factors: whether it was published in the US with a valid copyright notice and registration, and whether its US copyright was restored under the Uruguay Round Agreements Act (URAA) in 1996. A search of the Stanford Copyright Renewal Database and the Library of Congress Online Catalog (covering post-1978 records) yields no evidence of a US copyright registration or renewal for this film. Furthermore, there is no evidence that the film was distributed in the United States with a valid US copyright notice during the 1964–1977 'notice requirement' era. While the film is a cult classic, it has frequently appeared on platforms like the Internet Archive and in collections from gray-market distributors, which are common indicators of a lack of active US copyright enforcement. However, under 17 USC §104A (URAA), the US copyright of foreign works was automatically restored on January 1, 1996, if the work was still under copyright in its source country (Czech Republic) and was not in the US public domain due to expiration of term. As the film was created in 1964, it would have been under copyright in the Czech Republic in 1996. While no 'Notice of Intent to Enforce' (NIE) was filed with the US Copyright Office by the Czech State Film Industry or its successors, restoration is automatic and does not require an NIE to be valid against non-reliance parties. Because the presence of an initial US publication with notice cannot be confirmed or denied, and the automatic nature of URAA restoration creates a legal protection that is often not reflected in public registration databases, the status is marked as uncertain.
