Why this status applies
New York Nights (1929) was registered for copyright by Feature Productions, Inc. on January 31, 1930, under entry LP1031. For films published between 1928 and 1963, a renewal filing between the 27th and 28th year of the first term was required to maintain protection in the United States according to the 1909 Copyright Act.
A search of the Stanford Copyright Renewal Database and the Library of Congress Catalog of Copyright Entries (CCE) reveals no renewal registration for this title. Under the law at the time, failure to renew the registration during the 28th year caused the work to expire into the public domain. This film is a well-known example of a Norma Talmadge production that became public domain due to the lack of renewal activity by United Artists or its successor entities.
The film appears in multiple public domain film catalogs, including the Hurst 'Film Superlist' and David Pierce's renewal database, both of which confirm the absence of a renewal record. As a 1929 US production that was not renewed in 1957 or 1958, it is definitively in the public domain in the United States.
